Terms of Service

1. Acceptance of Terms

These Terms of Service form an agreement between you and Claus Marín Kaiser, an individual based in Ireland who operates Raivaly ("Raivaly", "the Platform","we", or "us").

By accessing or using the Platform, you agree to comply with these Terms. If you do not agree, you must not create an account or use authenticated Platform features.

Raivaly is currently in beta. Features, rules, supported competitions, and services may evolve as the Platform is developed.

These Terms should be read together with the Privacy Policy.

2. Eligibility and Accounts

Raivaly's public informational pages may be viewed without an account. You must be at least 16 years old to activate or use a Raivaly account.

By activating an account, you confirm that you meet this age requirement and that the information you provide is accurate. You must not create an account on behalf of a person who does not meet the requirement.

You are responsible for activity performed through your account and for taking reasonable steps to protect access to your chosen authentication provider. Accounts may not be sold, transferred, or shared in a way that misrepresents the person controlling them.

If you believe that your account has been accessed without authorisation, contact support@raivaly.com promptly.

3. Intellectual Property Disclaimer

Raivaly is an unofficial, community-driven fantasy platform. It is not affiliated with, endorsed, sponsored, or specifically approved by Nintendo, Game Freak, or The Pokémon Company International.

Pokémon names, trademarks, artwork, game materials, tournament results, and other third-party materials remain the property of their respective owners. They are referenced only for identification, commentary, statistical analysis, and the operation of the fantasy game. Raivaly claims no ownership over those third-party materials.

The Raivaly name, branding, original interface, written content, scoring calculations, and other original Platform materials may not be copied or presented as another service's work except where permitted by applicable law or with prior permission.

4. Statistics and Data Usage

Subject to these Terms, Raivaly grants users a limited, revocable, non-exclusive, and non-transferable licence to view and use its publicly displayed statistics for personal, non-commercial reference.

Without prior written permission, users may not bulk extract, systematically scrape, republish substantial portions, redistribute, resell, sublicense, or use Raivaly's compiled statistics to create a competing database, product, or service. Ordinary search-engine indexing in accordance with Raivaly's published crawler directives is permitted.

Raivaly retains any rights it may hold in its original scoring calculations, rankings, tiers, models, and the selection, compilation, and presentation of its statistics. Underlying factual event data and third-party materials remain subject to the rights of their respective owners.

Nothing in these Terms restricts quotation, research, interoperability, or another use that cannot lawfully be restricted.

5. Fantasy Competition and Scoring

Raivaly is a free-to-play fantasy platform designed for entertainment and amusement. There are no monetary entry fees, and Raivaly does not currently award real-money prizes. Raivaly is not a gambling, sports-betting, or daily fantasy sports operator.

Fantasy points, rankings, tiers, and standings are calculated using Raivaly's published or documented scoring rules and available competition data. Third-party tournament information may be incomplete, delayed, corrected, or unavailable.

Raivaly may correct statistical or scoring errors and recalculate event results, team points, standings, rankings, or tiers when source data changes or an error is identified.

Fantasy points, rankings, badges, achievements, and other Platform records have no monetary value and do not create a right to payment or compensation.

6. User Conduct and Acceptable Use

Users may create limited content on the Platform, including manager names and fantasy-team names. You must not submit content that is unlawful, threatening, abusive, defamatory, obscene, deceptive, discriminatory, or otherwise reasonably considered harmful.

You must not:

• Impersonate another person or misrepresent your identity.
• Attempt to access another user's account, private league, or restricted administrative feature.
• Exploit bugs or manipulate drafts, rosters, scores, waivers, or standings.
• Interfere with the Platform's operation, security, or availability.
• Use automated tools to create accounts, submit abusive requests, or circumvent published access restrictions.

Raivaly may rename or remove content, reverse an illegitimate action, restrict access, suspend an account, or terminate an account or team where reasonably necessary to enforce these Terms, protect users, preserve competition integrity, or secure the Platform.

7. Platform Availability and Enforcement

Raivaly may modify, suspend, or discontinue features where reasonably necessary for maintenance, security, legal compliance, product development, or the continued operation of the Platform.

We do not guarantee that every feature, event, ruleset, statistic, or third-party integration will always be available, error-free, or uninterrupted.

Where reasonably possible, Raivaly will provide notice of a material account restriction or termination. Immediate action may be taken where necessary to prevent abuse, protect data, or avoid harm to the Platform or its users.

8. Privacy and Account Deletion

Raivaly's collection and use of personal data is described in the Privacy Policy.

You may request deletion of your account and personal data as described in that Policy. Account deletion does not require Raivaly to delete or alter non-personal competition records.

Fantasy teams, transactions, locked event snapshots, scores, rankings, and standings may be retained after the associated manager identity has been removed or irreversibly anonymised. Retained records may display a neutral label such as"Deleted Manager" or "Former Team".

Deleting an account does not retrospectively invalidate fantasy results or points earned before deletion.

9. Disclaimers and Limitation of Liability

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. Raivaly does not guarantee the completeness, accuracy, continued availability, or suitability of statistics, scores, rankings, or third-party data.

To the maximum extent permitted by applicable law, Raivaly and its operator shall not be liable for indirect, incidental, special, consequential, or punitive loss arising from access to, use of, or inability to use the Platform, including loss of data, goodwill, opportunity, or expected fantasy results.

Nothing in these Terms excludes or limits liability, remedies, or consumer rights that cannot lawfully be excluded or limited.

10. Changes to these Terms

Raivaly may update these Terms as the Platform, its features, or its legal obligations evolve. The current version will remain available on this page, and the "Last updated" date will identify the latest revision.

Where a change materially affects registered users' rights or obligations, Raivaly will provide an appropriate notice and may request renewed acceptance before continued use of authenticated features.

11. Governing Law and Contact

These Terms are governed by the laws of Ireland, without regard to conflict-of-law principles. This does not deprive you of mandatory protections available under the law of the country in which you ordinarily reside.

If any provision of these Terms is found unenforceable, the remaining provisions will continue to apply.
